You are further advised that system administrators may provide evidence of possible criminal activity identified during such monitoring to appropriate law enforcement officials. If you do not wish to consent to monitoring, you should immediately cease using LymphProject.com.
7. Special Warning for International Use
Recognizing the global nature of the Internet, you further agree to comply with all applicable local rules including but not limited to rules regarding online conduct and acceptable content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from PORTUGAL or the country in which you reside.
8. LymphProject.com Communications
In the course of providing you with LymphProject.com, LymphProject.com may need to communicate with you via email. You agree to receive emails that are necessary for the normal functioning of LymphProject.com.

By accepting these Terms, you agree to indemnify and otherwise hold harmless LymphProject.com, its members, officers, employees, agents, co-branders or other partners, subsidiaries and affiliates from and against any and all claims, demands, actions, costs, liabilities, losses and damages of any kind (including reasonable attorneys’ fees) due to or arising from (a) your use of LymphProject.com, (b) your violation of the Terms or any rights of another, (c) unauthorized access to or alteration of your communications with or through LymphProject.com, and/or (d) any other matter relating to LymphProject.com.
12. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LymphProject.com EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OR TRADE, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. LymphProject.com MAKES NO REPRESENTATIONS OR WARRANTIES, OF ANY KIND, EITHER EXPRESS OR IMPLIED, (i) AS TO THE OPERATION OF LymphProject.com, THE INFORMATION, CONTENT, MATERIALS OR PRODUCTS INCLUDED ON LymphProject.com, (ii) THAT LymphProject.com WILL BE UNINTERRUPTED OR ERROR-FREE, (iii) AS TO THE ACCURACY, RELIABILITY OR CURRENCY OF ANY INFORMATION, CONTENT, SERVICE OR MERCHANDISE PROVIDED THROUGH LymphProject.com, (iv) OR THAT LymphProject.com AND/OR THE SERVER THAT MAKES SAME AVAILABLE ARE FREE OF VIRUSES, CLOCKS, TIMERS, COUNTERS, WORMS, SOFTWARE LOCKS, DROP DEAD DEVICES, TROJAN-HORSES, ROUTINGS, TRAP DOORS, TIME BOMBS OR ANY OTHER HARMFUL CODES, INSTRUCTIONS, PROGRAMS OR COMPONENTS, OR THAT ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED. 13. Limitations on Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT LymphProject.com SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF LymphProject.com HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM ANY MATTER RELATING TO LymphProject.com, OR YOUR USE OF OR INABILITY TO USE LymphProject.com. YOUR SOLE AND EXCLUSIVE RIGHT AND REMEDY WITH RESPECT TO ANY PROBLEMS OR DISSATISFACTION WITH LymphProject.com OR LymphProject.com IS TO DISCONTINUE ANY USE OF LymphProject.com. THE LIMITATIONS OF LIABILITY PROVIDED IN THE TERMS INURE TO THE BENEFIT OF US, OUR AFFILIATES AND ALL OF OUR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS AND ASSIGNS. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IF ANY PART OF THIS LIMITATION ON LIABILITY IS FOUND TO BE INVALID OR UNENFORCEABLE FOR ANY REASON, THEN THE AGGREGATE LIABILITY OF LymphProject.com UNDER SUCH CIRCUMSTANCES FOR LIABILITIES THAT OTHERWISE WOULD HAVE BEEN LIMITED SHALL NOT EXCEED FIFTY DOLLARS (US$50).
14. User Materials
Any material or information sent by you through or in connection with LymphProject.com and any content, products or services contained or marketed therein (including testimonials, remarks, questions, comments, ideas, graphics or other information) will be treated as non-confidential, non-proprietary, and will immediately become the property of LymphProject.com, except as otherwise provided in the Terms. LymphProject.com may use such materials as it seems fit, anywhere in the world, without obligation for compensation, and free of any moral, intellectual property or other rights to such information and materials. In addition, you acknowledge and agree that you have full responsibility for any information and materials you submit to us, including its legality, reliability, appropriateness, originality and copyright.
15. Disclaimer of Association With User
You acknowledge that no joint venture, partnership, employment or agency relationship exists between you and LymphProject.com or its authorized agents or contractors as a result of the Terms or use of LymphProject.com. You agree not to hold yourself out as a representative, agent, or employee of LymphProject.com. None of LymphProject.com, its authorized agents or contractors shall be liable for any representation, act or omission by you.
16. LymphProject.com Privacy Policy
All user information submitted through LymphProject.com and certain other information about you is subject to our Privacy Policy, the terms of which (as the same may be updated from time to time) are hereby incorporated into the Terms in their entirety by reference.
17. Entire Agreement
These Terms constitute the entire agreement between you and LymphProject.com and govern your use of LymphProject.com, superseding any prior agreements, oral or written, between you and LymphProject.com (including any prior versions of the Terms).
18. Governing Law/Venue
Except for trademark and copyright matters governed by the federal laws of Portugal , the Terms between you and LymphProject.com will be governed by and construed in accordance with the laws of the Portugal without regard to principles of conflict of laws. You and LymphProject.com agree to submit to the personal and exclusive jurisdiction of the courts located within Lisbon, Portugal.
19. General Information
The section titles of the Terms are displayed for convenience only and have no legal or contractual effect. The failure of LymphProject.com to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. If any provision of the Terms or any incorporated documents are found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect. LymphProject.com may provide notices of changes to the Terms, additional terms of service or other matters by displaying notices or links to notices to you generally on or through LymphProject.com. You agree that, except as otherwise expressly provided in these Terms, there will be no third-party beneficiaries to this agreement. LymphProject.com performance of the Terms is subject to existing laws and legal process and nothing contained in the Terms is in derogation of LymphProject.com right to comply with law enforcement requests or requirements relating to your use of this web site or information provided to or gathered by LymphProject.com with respect to such use.
We may assign our rights and delegate our obligations under these Terms, in whole or in part, at any time with or without notice to you. You may not assign any of your rights or delegate your obligations under these Terms to any other person. Any attempt by you to do so is void. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of LymphProject.com or the Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred.
